HEARING: May 21, 2001 APPEARANCES: Complainant failed to appear and Respondent failed to appear. ADMINISTRATIVE LAW JUDGE: Mark A. Silver _____________________________________________________________________

Prior to the date of the scheduled hearing, the Office of Administrative Hearings received a facsimile transmission from Complainant, indicating that it wished to cancel the scheduled hearing “on a contingency of 30 days,” in order to see if Respondent paid specified monies that were agreed upon. This office promptly notified Complainant that any request to vacate the scheduled rehearing was denied, due to the fact that the parties had vacated the original hearing on only one day’s notice, based on an earlier settlement agreement. Apparently, this prior settlement broke down and thus, Complainant requested the instant rehearing. The hearing in this matter was duly convened on the scheduled date and time. However, subsequent to convening the hearing but prior to the time that a Decision and Recommended Order could be issued, this Tribunal received another facsimile . . . . . . transmission from the parties, indicating that they stipulated to a dismissal with prejudice. Based on the foregoing, it is hereby recommended that this matter be dismissed with prejudice. Done this day, May 21, 2001
