IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Consolidated Hearing was set for April 19, 2001, before the undersigned administrative law judge of the Office of Administrative Hearings. In this matter, Case No. 00-1850/Docket No. 00F-1850-ROC, Sunrise Custom Homes, Inc. is captioned as Respondent. (In the other matter set for consolidated hearing, Case No. 00-2622/Docket No. 00F-2622-ROC, Sunrise Custom Homes, Inc. is captioned as Complainant.) Prior to hearing, on April 16, 2001, Respondent Sunrise Custom Homes, Inc. filed Voluntary Petition for Bankruptcy in Case No. 0104715 PHX SSC, United States Bankruptcy Court, District of Arizona. As a direct result of that petition, there now exists an automatic stay of proceedings against Respondent Sunrise Custom Homes, Inc., pursuant to 11 U.S.C. § 362(a). Therefore, good cause appearing, Case No 00-1850/Docket No. 00F-1850- ROC is vacated from the calendar of the Office of Administrative Hearings and IT IS HEREBY RECOMMENDED that the Citation in Case No. 00-1850 together with the Complaint upon which it is based, shall be closed unless and until Complainant herein files notice with the Registrar of Contractors, on or before the effective date of the Registrar’s Order entered in this matter, that it has instituted proceedings before the Federal Court seeking relief from the automatic stay. // // // Done this day, April 19, 2001.
