IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was set for hearing on June 2, 2000, but prior to the commencement of the hearing, the parties advised the Office of Administrative Hearings that they had mutually resolved the contested issues. The record was kept open for twenty days to allow the parties’ legal counsel to submit a written settlement agreement. The Office of Administrative Hearings has not received a written settlement agreement, but has twice received the oral representations of the parties’ legal counsel that the matter has been resolved. The Administrative Law Judge informed counsel that he would submit this recommended decision to the Arizona Registrar of Contractors (“Registrar”) not later than June 22, 2000. No objection was received to this action. Parties may resolve a contested case by agreed settlement. Arizona Revised Statutes § 41-1092.07(F)(5). Accordingly, IT IS ORDERED vacating the hearing and recommending to the Registrar that Citation and Complaint No. 00-1826 be dismissed. ORDERED AND SUBMITTED this 22d day of June, 2000.
