This matter involves claims for nonpayment for materials and services. The matter was set for hearing on May 4, 2000, but prior to the commencement of the hearing, the parties advised the Office of Administrative Hearings that they had mutually resolved the contested issues and were in the process of finalizing the needed documents. As of May 22, 2000, the parties had not filed a motion to vacate the hearing but had neither filed a request to hold a hearing. Parties may resolve a contested case by agreed settlement. Arizona Revised Statutes § 41- 1092.07(F)(5). Accordingly, IT IS ORDERED vacating the hearing and recommending to the Arizona Registrar of Contractors that Citation and Complaint No. 00-1269 be dismissed.
