IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter is a claim for breach of settlement agreement previously made in May, 2000. The case, which involves claims for nonpayment of materials and services, is scheduled for hearing on October 6, 2000. On September 22, 2000, Paul L. Stoller, Esq., representing Complainant Five Star Ford, Inc., and Mr. Charles M. Spencer, acting on behalf of Respondent S C M Builders, Inc., filed a Stipulation for Dismissal With Prejudice. The parties have mutually resolved the contested issues and have stipulated “that [this] matter may be dismissed with prejudice.” Parties may resolve a contested case by agreed settlement.[1] Accordingly, IT IS ORDERED vacating the hearing set on October 6, 2000, and recommending to the Arizona Registrar of Contractors that the reopening of Citation and Complaint No. 00-1269 be dismissed.
