This matter involves claims for nonpayment for materials and services. Prior to the commencement of the hearing, the parties reviewed and discussed the contested issues. The Administrative Law Judge did not participate in the discussions. The parties agreed to resolve mutually the contested issues, and their agreement was formalized in the record of the hearing. Both parties avowed their agreement was a proper and fair disposition of this matter. Parties may resolve a contested case by agreed settlement. Arizona Revised Statutes § 41-1092.07(F)(5). Based upon the mutual agreement of the parties, Administrative Law Judge George A. Schade, Jr. submits this Recommended Decision and Order to the Arizona Registrar of Contractors (“Registrar”). The terms of the agreed settlement are: 1. Respondent Moran Contracting and Development, Inc. will pay Complainant England Electric on this day the amount of Five Hundred Dollars and No Cents ($500.00) in settlement of both claims in this matter. 2. England Electric withdraws Complaint No. 00-1021. The Administrative Law Judge reminded the parties that failure to complete this agreement may result in compliance action by the Registrar. RECOMMENDED ORDER It is recommended that the Registrar: 1. Accept and approve the agreement of the parties. 2. Close Citation and Complaint No. 00-1021. SUBMITTED this 16th day of March, 2000.
