IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Empire Metals’ attorney has informed the undersigned that, because the parties’ dispute has been resolved to her satisfaction, she withdraws her request for a formal hearing. In view of the parties’ settlement, IT IS ORDERED that the hearing scheduled to convene on April 27, 2000 be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that it be dismissed. Done this day, April 26, 2000.
