IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On June 29, 2000, the Executive Director of the Board of Psychologist Examiners (“Board”) filed a request to withdraw this matter from the docket of the Office of Administrative Hearings and to vacate the formal hearing scheduled for July 7, 2000. On June 30, 2000, a telephonic pre-hearing conference was conducted with the undersigned Administrative Law Judge, Michael D. Wolver, Esq., counsel for the Respondent, and Assistant Attorney General Nancy J. Beck, counsel for the Board, to discuss the request. Counsel advised that the parties had agreed to vacate the hearing and to remand this matter to the Board so that the Board can exercise jurisdiction in an attempt to resolve the dispute without going to formal hearing. In view of the foregoing, IT IS ORDERED, pursuant to A.A.C. R2- 19-111, that the hearing on July 7, 2000, be vacated from the calendar of the Office of Administrative Hearings, and that this matter be remanded to the Board. Counsel shall advise the subpoenaed witnesses of this order. If this matter is subsequently resubmitted to the Office of Administrative Hearings for formal hearing, all reasonable efforts will be made to have it assigned to the undersigned Administrative Law Judge as requested by counsel.
