This matter was scheduled for administrative hearing before the Office of Administrative Hearings on May 8th, 2000, at 1:30 p.m. The Department of Liquor Licenses and Control, through counsel, filed a Motion to Dismiss Complaint in this matter on April 13th, 2000, stating that it does not intend to proceed to hearing on the subject allegations. The Department requested that the hearing be vacated and the case dismissed with prejudice. Wherefore, and pursuant to A.A.C. R2-19-111.2., it is hereby ordered that the motion to vacate the hearing is granted, and this matter returned to the agency for further action with a recommendation of dismissal with prejudice.
